NiPHEC 2015 To Hold June 14 – 20, 2015


The forthcoming edition of the 3rd annual Nigeria Photography Expo and Conference slated for April 6 – May 2 (2015) has been postponed to June 14 – June 20. The 7-weeks shift in date has been necessitated due to the political atmosphere in the country which has affected not just the logistics of organising a successful conference but  also (in more ways than anticipated) the economy of the country.

We strongly believe that the political dust would have settled once the new President of Nigeria is inaugurated by May 29 thereby giving way for many organisations & individuals to part of this monumental event in the photography industry.

Consequently the newly updated schedule will be put up as soon as we confirm the availability of our speakers &  facilitators. We wholeheartedly apologize for whatever inconvenience this might have caused the multitude of attendees that have scheduled their annual leave/holiday during the previously set dates. Kindly share the new dates with those you know might be planning to attend.

The Hot-Tempered Photographer


I was recently told the story of one of my relatives that once ran a photography business. It happened that after delivering the finished product (albums, photo frames, etc) to his clients, he usually had a challenge getting his outstanding balance from them.

A client that owed him a balance of N20k would offer to pay 10 installments of N2k and my photographer “relative” will vehemently reject the offer. He would get so angry at the client that he would eventually tell the client not to bother paying the balance. He would repeat the same gesture to most of his clients.

This eventually became one of the main reasons why Relative Photography Studios is no longer in business. If you were in his shoes, how would you react to someone that owes you N20k and is offering to make 10 installments (or other seemingly outrageous offer) of N2k each?

A Debtor’s INTEGRITY, A Creditor’s REGRET


I can’t remember ever having to do a writeup with a heart as heavy as what I’m experiencing now. However my silence might only add to the increasing level of decline in character seen in men & women in our society. One thing I’ve learnt in the last 16 years of my short life (especially while running my first internet-based company in America) is the fact that one of the most valuable asset in life you can have is a character of INTEGRITY. Integrity can take 20 years to build and 1 hour to destroy. It is one aspiration I’m still gunning for.

And so it was that while I was relaxing outside a shopping mall near my office & thinking of the next inspirational writeup to put up on my network, I found myself face to face with the last person I ever thought I’ll meet: one of my CREDITORS. As the organizer of the Nigeria Photography Expo & Conference (NiPHEC), I had ended up in a debt so huge that it shook the foundations of my life and marriage. Every vendor that came on board to make it a monumental success agreed to support based on the reputation I was perceived to have. The graphic artist, conference speakers (local & foreign), location provider, event planner, videographer, printer & other vendors had to give me a line of credit for providing their various services with the hope that I’ll pay up before or during the conference.

Unfortunately, we were not able to get enough sponsors on board to cover the entire $87,000 cost of organizing the event. The resulting debt will leave me in a state of embarrassment to the extent that I was atimes reluctant to even pick up my phone when it rang. It was even more painful when people started calling & emailing me shortly after the conference to CONGRATULATE me on the SUCCESS of a conference that left me more broke than when I started. And there I was thinking “it’s easy for you to call it a success when you’re not the one footing the debt”.

The management of the venue we used cut us some slack and accepted the 40% deposit we could raise to secure the venue 2 days before start of NiPHEC. The balance was to be paid during the conference with the hope that we’ll get enough participants to cover the bill; we were not able to come up with the balance. And the biggest character-wrecking mistake I did was NOT to get back to them since the conclusion of the conference.

So you can picture how heart-wrenching it was when you slam into someone you owe money for months and haven’t paid up yet. Telling them that you were recently thinking about getting in touch with them would not be a great excuse. Telling them that you were depressed, terminally ill or heart broken will not change the fact that the perception they had of you has eroded. You then discover that your heart can beat 755 times per minute when they tell you that “they regretted ever working with you and will not be that generous to anyone EVER again”.

I had never been in that kind of monumental debt situation before and I know that I didn’t handle the communication part well. It would have been better if I had called them often to keep them posted regarding the situation of things at my end. It would have been better if I had approached them to explain my situation rather than wait to stumble unto them. At that moment, my heart felt as though I had killed someone….as if I had committed the Judas-Iscariot sin. I felt like the multitude of many Nigerians that had been labeled fraudstars. IF ONLY I HAD KEPT THE COMMUNICATION LINES OPEN.

For the next 40 minutes, I would walk the remorseful distance back to my office like one who had lost his family in an earthquake. Upon getting back to the office I decided to call everyone that I had already contacted prior to now to appeal to them to still give me some time to clear my debt. Interestingly, they empathized with me and told me that they trust me to pay up whenever I had the resources. If only I had made the calls earlier.

As someone who has been in business for while, I still have Pastors, Ministers of God, students, friends and clients who still owe me money for a service I provided. I’ve made it a point not to be someone who gets angry at any debtor for not keeping in touch with me especially since I’ve committed the same offense with my creditors. It’s a character flaw a lot of us need to work on so that at the end of our days we shall be regarded as “blameless before God & man”.

At the end of my days, may my character be like the one whose Master shall gladly say “Well done, good & faithful servant”. May God help me. MAY GOD HELP US ALL.

 

The Psychiatric Ward Nurse


So I met this gentleman on March 2 and he stopped me to tell me that I looked very familiar. I said I couldn’t remember his face (something that rarely happens) and he told me he can remember me clearly. I asked from where can he remember me and after 4 seconds of thinking he concluded: Psychiatric Ward Yaba.

I assured him that it definitely wasn’t me and he asks me “Are you sure?” I was 100% sure. He asked if I had ever been to the psychiatric ward and I told him NEVER. Apparently he is a nurse at the ward and was on his way to his office.

I decided to put it up here knowing it might help to “enlighten” potential clients also. You’re free to use and adapt to your specific needs. It will help reduce the conflicts between photographers & clients after the pictures have been taken.

Package Delivery Date: Album pictures shall be uploaded to http://www.eloclients.com on February 2, 2009 by 12noon. The album shall be printed and delivered not later than one week after the pictures have been approved by the bride & groom.

The parties have read the conditions of this Agreement, agree to all its terms, and acknowledge receipt of a complete copy of the Agreement signed by both parties. Each person signing as Client below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.

This Agreement is subject to all the terms and conditions on the following page (please read carefully):

1. Exclusive Photographer. The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding. Family and friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with the Photographer’s duties and do not photograph poses arranged by the Photographer.

2. Deposit and Payment. The Client shall make a deposit of N50,000 to retain the Photographer to perform the services specified herein. The balance shall be due 3-4 weeks before the date of the event. Refusal to pay the balance before the date of event will result in delays in the date of delivery of the album (s). No part of any order will be delivered or uploaded to the internet until payment is made in full. If the Client refuses to pay the necessary deposit within thirty (30) days after the event, Client shall be in default hereunder and shall pay 5% monthly interest on the unpaid balance until payment is made in full. Payments shall be made either in person or cheque/cash deposit into our Guaranty Trust Bank account 211-744703110 under eloPhotos Studio Enterprises.

3. Order Changes. Once a service is chosen or an order is placed and all necessary payments made, the sale is final and nonrefundable. No verbal changes will be accepted. Any schedule or order changes must be documented, submitted, and signed by both the contracting party/parties and the eloPhotos for confirmation and mutual authorization.

4. Cancellation. If the Client shall cancel this Agreement sixty (60) or more calendar days before the wedding date, any deposit paid to the Photographer shall be refunded in full. If Client shall cancel within sixty days of the wedding date and if the Photographer does not obtain another assignment for that date, liquidated damages shall be charged in a reasonable amount not to exceed the deposit.

5. Photographic Materials. All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. The Photographer shall make proofs and previews available to the Client for the purpose of selecting photographs. The Photographer may, with the Client’s permission, make the proofs available on a Web site or CD-ROM.

6. Copyright and Reproductions. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.

7. Client’s Usage. The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer. If Client is obtaining a print for newspaper announcement of the wedding, Photographer authorizes Client to reproduce the print in this manner. In such event, Client shall request that the newspaper run a credit for the Photographer adjacent to the photograph, but shall have no liability if the newspaper refuses or omits to do so.

8. Failure to Perform. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

9. Photographer. The Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness or of scheduling conflicts. In the event of such substitution, Photographer warrants that the photographer taking the photographs shall be a competent professional.

10. Inherent Qualities. Client is aware that color dyes in photography may fade or discolor over time (usually after 20yrs) due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

11. Photographer’s Standard Price List. The charges in this Agreement are based on the Photographer’s Standard Price List and are only guaranteed once deposit is made. This price list is adjusted periodically and future orders shall be charged at the prices in effect at that time.

12. Client’s Originals. If the Client is providing original prints, negatives, or transparencies owned by the Client to the Photographer for duplication, framing, reference, or any other purpose, in the event of loss or damage the Photographer shall not be liable for an amount in excess of N2000 per image.

13. Miscellany. This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the Federal Republic of Nigeria

For every photographer/artist out there that use their works as DPs, it is important you watermark them because you never know where they might end up
